1. DEFINITIONS

1.1 “Company” means PT Nebesa Nusantara Utama, owner of the registered brand name Balicopter and commercial organizer of helicopter experiences.

1.2 “Operator” means the licensed Air Operator Certificate (AOC) holder responsible for operating the helicopter flight.

1.3 “Passenger” means any individual participating in a helicopter flight booked through the Company.

1.4 “Pre-Flight Registration” means the mandatory submission and confirmation of passenger information required for aviation regulatory compliance and flight manifest preparation, as defined in Clause 4.

1.5 “Shared Tour” means a per-seat helicopter experience where multiple unrelated passengers may share the same aircraft.

1.6 “Private Charter” means a helicopter flight booked on a per-aircraft basis.

1.7 “Empty Leg” means a repositioning flight made available for booking due to an existing confirmed charter operation.

2. ROLE OF THE COMPANY

2.1 PT Nebesa Nusantara Utama is the owner of the registered brand name Balicopter and acts as the commercial booking and organizing entity.

2.2 All helicopter flights are operated by licensed Air Operator Certificate (AOC) holders in accordance with Indonesian aviation regulations.

2.3 The Operator retains full operational control of the aircraft and crew.

2.4 The Pilot-in-Command has final authority over all operational and safety decisions.

3. BOOKING AND PAYMENT

3.1 A booking is confirmed once full payment has been received or written confirmation has been issued by the Company.

3.2 Pricing structure:

a) Shared Tours – priced per passenger
b) Private Charters – priced per helicopter (unless otherwise specified)
c) Transfers – quoted on a one-way basis unless stated otherwise

3.3 Accepted payment methods may include bank transfer, credit/debit card, or approved online payment systems. Processing fees may apply.

3.4 All prices are payable in Indonesian Rupiah (IDR) unless otherwise agreed in writing.

4. PRE-FLIGHT REGISTRATION (MANDATORY)

4.1 Pre-Flight Registration is required for all Passengers to comply with aviation regulations.

4.2 Pre-Flight Registration shall include submission of:

a) Full legal name (as per passport or ID)
b) Passenger body weight
c) Luggage weight (if applicable)
d) Copy of valid identification
e) Disclosure of relevant medical conditions

4.3 Pre-Flight Registration is deemed completed once:

a) All required information has been submitted; and
b) The Operator confirms the departure time and reporting time via the communication channel used for booking.

4.4 Upon completion of Pre-Flight Registration:

a) The passenger manifest is finalized;
b) Weight and balance calculations are completed;
c) Flight slot allocation is secured.

4.5 Passengers must arrive at the helipad at least twenty (20) minutes prior to confirmed departure time unless instructed otherwise.

4.6 Inaccurate weight declaration or incomplete documentation may result in refusal of boarding for safety reasons without refund.

5. OPERATIONAL CONDITIONS

5.1 Maximum passenger weight: 130 kilograms per person.

5.2 Maximum seating capacity: four (4) passengers per helicopter unless otherwise specified.

5.3 Children over twenty-four (24) months require a separate seat.

5.4 Luggage is limited and subject to operational approval.

5.5 All flights must conclude at least thirty (30) minutes before sunset in accordance with aviation regulations.

5.6 Flights are subject to weather conditions, air traffic control clearance, and operational limitations.

6. CANCELLATION AND REFUND POLICY

6.1 Complimentary Cancellation

A full refund shall be granted if cancellation occurs:

a) At least twenty-four (24) hours prior to departure; or
b) Before Pre-Flight Registration is completed;

whichever occurs first.

6.2 Cancellation After Pre-Flight Registration

Once Pre-Flight Registration is completed, the flight is considered operationally secured.

6.2.1 Shared Tours

a) Cancellation is not permitted after Pre-Flight Registration.
b) Payment becomes non-refundable.
c) No-show shall be charged at one hundred percent (100%).

6.2.2 Empty Leg Flights

a) Cancellation is not permitted after Pre-Flight Registration.
b) Payment becomes non-refundable.

If the underlying charter operation is cancelled by the Operator, a full refund shall be issued.

6.2.3 Private Charters

a) Cancellation within twenty-four (24) hours of departure is non-refundable.
b) Earlier cancellation requests may be eligible for rescheduling, subject to availability and operational feasibility.
c) Rescheduling is not guaranteed.

7. OPERATOR-INITIATED CANCELLATION

7.1 If a flight is cancelled due to:

a) Weather conditions;
b) Airspace restrictions;
c) Technical reasons;
d) Safety considerations;

Passengers may elect:

i) Full refund; or
ii) Rescheduling subject to availability.

7.2 All safety decisions are final and made by the Pilot-in-Command.

8. NO-SHOW

8.1 Failure to:

a) Arrive at the confirmed reporting time; or
b) Complete Pre-Flight Registration within the required timeframe

shall be treated as a no-show.

8.2 No-show bookings are non-refundable.

9. FORCE MAJEURE

9.1 The Company shall not be liable for delays or cancellations caused by events beyond reasonable control, including but not limited to severe weather, government restrictions, airspace closures, or natural disasters.

10. LIABILITY

10.1 All flights are conducted under the aviation insurance and regulatory framework of the operating AOC holder.

10.2 The Company’s liability is limited to the extent permitted under applicable Indonesian law.

10.3 The Company shall not be liable for indirect, incidental, or consequential losses.

11. GENERAL PROVISIONS

11.1 During the course of normal operations, the Company or its partners may capture photographs or video footage for documentation, service quality, or promotional purposes. By participating in a flight, Passengers acknowledge and consent to such use.

If a Passenger prefers not to appear in marketing materials, a written request may be submitted to the Company at any time, and reasonable efforts will be made to cease further use of identifiable imagery.

11.2 These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Indonesia.
